Terms and Conditions
1. Acceptance of Terms. By accessing or using the educational software ("Software"), you agree to be bound by the terms and conditions set forth in this agreement ("Agreement").
2. License Grant. Subject to the terms and conditions of this Agreement, we grant you a limited, non-exclusive, non-transferable license to access and use the Software solely for educational purposes.
3. Consent and Privacy Policy Notice. By agreeing to these Terms and Conditions, you are aware of, and consent to, administrator access to non-private account details of your account as needed for customer support. We may collect certain personal information from you in connection with your use of the Software, and you consent to our collection, use, and disclosure of your personal information as described in our Privacy Policy.
4. Restrictions. You may not: (a) modify, adapt, translate, reverse engineer, or create derivative works of the Software or its source code; (b) remove or alter any copyright, trademark, or other proprietary notices from the Software; or (c) use the Software for any unauthorized or unlawful purpose.
5. Termination and Refunds. We may terminate your access to the Software at any time, with or without cause, without prior notice or liability. All sales are final and no refund will be issued.
6. Intellectual Property. The Software and all intellectual property (“IP”) rights therein are and shall remain the sole and exclusive property of CFI. By directly sending us any inquiry, question, comment, suggestion, idea, or other information about the Software (“Submissions”), you agree to assign to us all IP rights in such Submission, and that CFI is entitled to use and disseminate it for any lawful purpose without acknowledgment or compensation to you.
7. Contributions. The Software may invite you to chat, contribute to, or otherwise participate in the exchange of information in various forms (“Contributions”). You understand that Contributions may be viewable by other users of the Software and possibly through third-party websites. Any Contributions you transmit may be treated as non-confidential and you grant us an unrestricted license to their use.
8. Third-party Websites. The Software and any accompanying services may contain or include links to other websites ("Third-Party Websites") as well as articles, text, graphics, sound, video, information, applications, software, and other content belonging to or originating from third parties ("Third-Party Content"). Such Third-Party Websites and Third-Party Content are not investigated, monitored, or checked for accuracy, appropriateness, or completeness by CFI, and we are not responsible for any Third-Party Websites accessed or any Third-Party Content posted on, available through, or installed from the Software or any accompanying services, including the content, accuracy, offensiveness, opinions, or other policies of or contained in the Third-Party Websites or the Third-Party Content.
9. Disclaimer of Warranties. THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.
10. Governing Law. This Agreement shall be governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of laws principles.
By accessing or using the Software, you acknowledge that you have read, understood, and agree to be bound by this Agreement.
